School/Department The purpose of this agreement, made in accordance with Section 5730 of the Employee Handbook, attached as Appendix B, is to provide for the reimbursement of monies paid by University for the benefit of Recipient, hereinafter referred to as Payments, to assist Recipient in taking specified courses of study or training or to attain a specific educational objective, namely ________________________________ hereinafter referred to as authorized education. Name of Degree In consideration of the mutual terms, conditions, and covenants herein contained, it is agreed by and between the parties hereto as follows: 1. AUTHORIZED EDUCATION. Recipient is enrolled at ____________________________________, pursuing the authorized education with completion Institution thereof planned by __________________. Recipient is eligible for subsidized study, having Date worked for the University for at least one academic year. 2. PAYMENT BY UNIVERSITY. University shall continue Recipient on salary for _________________________________, not to exceed 22 months. In addition to payment of Period of Time a regular salary, University will subsidize Recipients advanced studies in accordance with the stipulations identified in Appendix A: Specifications Relative to Subsidy of Advanced Study. 3. AMORTIZATION OF COSTS BY SERVICE TO UNIVERSITY. Upon the completion of the authorized full-time educational leave, Recipient agrees to perform full-time service for University at the then current salary rates of University for a minimum of five years. The total of all Payments made by University for Recipient, under this agreement, shall be amortized by Recipients service at a rate of 20% of the total for each year of full-time service following completion of the authorized education. If recipient engages in part-time, summers only, study leave, Recipient agrees to perform full-time service for University at the then current salary rate during the academic year immediately following the summer study leave, thus amortizing study on a yearly basis. 4. UNAMORTIZED REPAYMENT. Recipient shall immediately repay in cash to University the entire unamortized balance of Payments provided under this agreement and prior unamortized Payments, if any, plus accumulated interest at the current prime rate per annum from the date the Payment was made, in the event that: a. Recipient fails to complete the authorized education specified above by the date specified in Paragraph 1 above, (this date is subject to continuing review and may be extended by mutual agreement of the parties in writing; or b. Recipient fails to begin full-time service to University immediately upon completion of the authorized education or at the agreed upon time; or c. Recipient voluntarily leaves the employment of University for any reason other than death or disability that prevents Recipient from working for University prior to full amortization of Payments; or d. Recipient voluntarily terminates or abandons pursuit of the authorized education, whether or not Recipient is employed by University; or e. Recipient is terminated from University employment for cause. 5. REDUCTION OF AMOUNT DUE. Should the University discontinue the employment of the recipient, for reasons other than termination for cause, before the total amount advanced has been amortized, Recipient is responsible to reimburse the University one half (1/2) of the total unamortized Payments then outstanding unless otherwise negotiated. 6. CANCELLATION OF DEBT UPON DEATH OR DISABILITY. Provided that all of the terms of this Agreement have heretofore been met, any indebtedness owed by the Recipient to the University shall be automatically canceled upon the Recipients death or permanent disability that prevents Recipient from working for University. 7. MISCELLANEOUS. Modification of this Agreement or additional provisions hereto may be evidenced by one or more exhibits attached hereto. Any such exhibit which has been duly executed by the parties shall be deemed to be incorporated by this reference and shall have the same force and binding effect as though set forth in full herein. Otherwise, this Agreement shall set forth the entire Agreement of the parties with respect to the subject matter hereof and the same shall not be subject to oral modification or to any additional provisions which are not evidenced by an addendum hereto duly executed by the party to be charged.
